By downloading, installing, or using the nomp application (the "app"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app.

These terms are provided by Wise Eyes, a Swiss sole trader company.

2. License Grant

Wise Eyes grants you a limited, non-exclusive, non-transferable license to use nomp on your personal iOS device for your own personal, non-commercial use. This license does not include the right to:

- Modify, reverse engineer, or create derivative works of the app

- Rent, lease, loan, or sell the app

- Remove or alter any proprietary notices or labels

- Use the app in any way that violates applicable laws or regulations

- Transfer or sublicense your rights to another person

3. User Responsibilities

When using nomp, you agree to:

- Provide accurate and complete information when creating your account

- Maintain the confidentiality of your account credentials

- Accept full responsibility for all activities conducted through your account

- Use the app only for lawful purposes and in accordance with these terms

- Respect the rights of other users

- Not engage in any form of harassment, abuse, or threatening behaviour

4. Prohibited Conduct

You may not:

- Use the app to harass, threaten, or harm others

- Attempt to gain unauthorised access to the app or its systems

- Interfere with the normal operation of the app

- Use automated tools to collect data or extract content from the app

- Impersonate another person or entity

- Engage in any form of fraud or deception

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISE EYES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WISE EYES MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WISE EYES DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS.

7. Modifications to the App

Wise Eyes reserves the right to modify, suspend, or discontinue the app (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the app.

8. Termination

Wise Eyes may terminate or suspend your account and access to the app immediately, without prior notice or liability, if you violate any provision of these terms or engage in conduct that Wise Eyes reasonably believes is unlawful or harmful.

You may terminate your account at any time by deleting the app from your device and requesting account deletion at contact@wiseeyesopen.com.

9. Intellectual Property

All content, features, and functionality of the app, including but not limited to the design, text, graphics, and code, are the exclusive property of Wise Eyes or its content suppliers and are protected by international copyright and intellectual property laws.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Switzerland, and you irrevocably submit to the exclusive jurisdiction of the courts of Switzerland.

11. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12. Entire Agreement

These Terms of Service constitute the entire agreement between you and Wise Eyes regarding your use of the app and supersede all prior agreements and understandings, whether written or oral.
